{"id":374388,"date":"2023-10-02T18:03:27","date_gmt":"2023-10-02T16:03:27","guid":{"rendered":"https:\/\/earthavocats.com\/?p=374388"},"modified":"2023-10-10T15:26:13","modified_gmt":"2023-10-10T13:26:13","slug":"reconstruction-degradations-violences-urbaines-urbanisme","status":"publish","type":"post","link":"https:\/\/earthavocats.com\/en\/2023\/10\/02\/reconstruction-degradations-violences-urbaines-urbanisme\/","title":{"rendered":"Pour une reconstruction simplifi\u00e9e des b\u00e2timents d\u00e9grad\u00e9s apr\u00e8s les violences urbaines de l\u2019\u00e9t\u00e9 2023"},"content":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-en\">Sorry, this entry is only available in <a href=\"https:\/\/earthavocats.com\/fr\/wp-json\/wp\/v2\/posts\/374388\" class=\"qtranxs-available-language-link qtranxs-available-language-link-fr\" title=\"Fr\">Fr<\/a>.<\/p><p><b>Par Pierre-Eric SP<\/b><strong>ITZ, Avocat of counsel&nbsp;&amp;<\/strong><b> Giulietta RANIERI<\/b><\/p>\n<p>Le 02\/10\/2023<\/p>\n<p>Prise en application de la loi n\u00b02023-656 du 25 juillet 2023, l\u2019ordonnance n\u00b02023-870 du 13 septembre 2023, tendant \u00e0 l\u2019acc\u00e9l\u00e9ration de la d\u00e9livrance et la mise en \u0153uvre des autorisations d\u2019urbanisme permettant la reconstruction et la r\u00e9fection des b\u00e2timents d\u00e9grad\u00e9s au cours des violences urbaines survenues du 27 juin au 5 juillet 2023, est venue d\u00e9roger aux dispositions l\u00e9gislatives et r\u00e8glementaires du code de l\u2019urbanisme.&nbsp;<\/p>\n<p>Il est important de pr\u00e9ciser que les r\u00e8gles pos\u00e9es par cette ordonnance sont temporaires car elles s\u2019appliquent uniquement aux \u00ab demandes d\u2019autorisations d\u2019urbanisme d\u00e9pos\u00e9es dans les dix-huit mois \u00e0 compter de son entr\u00e9e en vigueur \u00bb, \u00e0 savoir jusqu\u2019au 14 mars 2025.<\/p>\n<p>Force est de constater que les r\u00e8gles pos\u00e9es par cette ordonnance facilitent grandement la reconstruction des b\u00e2timents. En effet, le propri\u00e9taire d\u2019un bien d\u00e9truit lors des violences urbaines a la possibilit\u00e9 de le reconstruire \u00e0 l\u2019identique, sous r\u00e9serve qu\u2019il ait \u00e9t\u00e9 r\u00e9guli\u00e8rement \u00e9difi\u00e9, m\u00eame si le plan local d\u2019urbanisme (PLU) ou la carte communale s\u2019y oppose.<\/p>\n<p>Bien qu\u2019il soit impossible de modifier la destination initiale du b\u00e2timent, des adaptations et des am\u00e9liorations sont envisageables dans la limite des 5% de son gabarit initial. Il peut \u00eatre d\u00e9rog\u00e9 \u00e0 ce seuil si les modifications sont justifi\u00e9es par un objectif d\u2019am\u00e9lioration de la performance \u00e9nergique, d\u2019accessibilit\u00e9 ou de s\u00e9curit\u00e9.<\/p>\n<p>En somme, le propri\u00e9taire dispose d\u2019une marge de man\u0153uvre particuli\u00e8re dans la reconstruction de son b\u00e2timent et d\u2019une assez grande flexibilit\u00e9.<\/p>\n<p>En ce qui concerne les d\u00e9lais des proc\u00e9dures habituelles en mati\u00e8re d\u2019autorisation d\u2019urbanisme, cette ordonnance les raccourcit consid\u00e9rablement. Les op\u00e9rations et les travaux de d\u00e9molition, de terrassement et de fondation pourront \u00eatre engag\u00e9s d\u00e8s le d\u00e9p\u00f4t de la demande ou de la d\u00e9claration pr\u00e9alable c\u2019est-\u00e0-dire sans attendre l\u2019autorisation d\u2019urbanisme.<\/p>\n<p>C\u2019est dans ce cadre, que le maire proc\u00e8de dans \u00ab les meilleurs d\u00e9lais \u00bb \u00e0 l\u2019affichage en mairie ou \u00e0 la publication par voie \u00e9lectronique sur le site de la commune d\u2019un avis de d\u00e9p\u00f4t de demande de permis de construire ou de d\u00e9claration pr\u00e9alable, t\u00e9moignant \u00e0 nouveau d\u2019une volont\u00e9 de ne pas perdre de temps.<\/p>\n<p>Toujours \u00e0 propos des d\u00e9lais, ceux pr\u00e9vus habituellement par le code de l\u2019urbanisme sont raccourcis :<\/p>\n<ul>\n<li>Le d\u00e9lai dont dispose l\u2019autorit\u00e9 comp\u00e9tente pour notifier les pi\u00e8ces manquantes au demandeur passe de 1 mois \u00e0 compter de la r\u00e9ception du dossier \u00e0 5 jours.<\/li>\n<li>Le d\u00e9lai d\u2019instruction pour les demandes de permis de construire, d\u2019am\u00e9nager, ou de d\u00e9molir limit\u00e9 \u00e0 3 mois ou 2 mois pour les maisons individuelles est r\u00e9duit \u00e0 1 mois.<\/li>\n<li>Le d\u00e9lai d\u2019instruction pour les d\u00e9clarations pr\u00e9alables est r\u00e9duit \u00e0 15 jours, se substituant alors au d\u00e9lai habituel d\u2019un 1 mois.<\/li>\n<\/ul>\n<p>Enfin, l\u2019autorit\u00e9 comp\u00e9tente a 5 jours pour transmettre \u00e0 l\u2019organisme ou \u00e0 l\u2019autorit\u00e9 administrative le dossier n\u00e9cessitant son avis, accord ou autorisation pr\u00e9alable. Ces autorit\u00e9s ont alors 15 jours pour se prononcer, leurs silences valant acceptation de la reconstruction ou avis favorable.<\/p>\n<p>En cas de majoration du d\u00e9lai d\u2019instruction, celle-ci ne pourra d\u00e9passer les 15 jours \u00e0 compter de la r\u00e9ception du dossier par l\u2019organisme ou l\u2019autorit\u00e9 administrative, ce d\u00e9lai passant \u00e0 45 jours si la reconstruction n\u00e9cessite une participation du public.<\/p>\n<p>En r\u00e9sum\u00e9, la facilitation de la reconstruction passe donc aussi par la diminution des d\u00e9lais de droit commun, acc\u00e9l\u00e9rant ainsi la d\u00e9livrance et la mise en \u0153uvre des autorisations d\u2019urbanisme.<\/p>\n<p>Pour finir, l\u2019ordonnance autorise une d\u00e9rogation \u00e0 la proc\u00e9dure de participation du public pr\u00e9vue par le Code de l\u2019environnement, en favorisant celle-ci par voie \u00e9lectronique en lieu et place de l\u2019enqu\u00eate publique.
