1 – Protection of personal data

The Earth Avocats website operated by the SELARL Earth Avocats, publisher of the present document, implements the processing of personal data.

The following explains how this data is collected and how it is used. The personal data that is collected varies depending on how the services are used. The personal data collected or held is directly communicated by the person browsing the website, or it is obtained from third parties, or it is collected from website activity and use of the services.

2 – Commercial and marketing prospecting

The following information is collected and processed: contact information, such as name, first name, home address, country of residence, telephone number and/or cell phone number, e-mail address, social network login information.

The use of this information representing personal data has the following purpose: To send communications about products and services, for commercial prospecting purposes.

These communications may take the form of an email or postal mail, a text message, a phone call or targeted online advertising. This data is kept for marketing purposes for a maximum of three (3) years.

Where data has been collected in connection with the provision of a service or after inquiries, information on similar or targeted services or inquiries based on previous queries may be sent, unless the person concerned requests that such commercial communications be discontinued or chooses not to receive them.

This data is kept for prospecting purposes for up to three (3) years after the collection of the data. Each time an electronic communication for commercial prospecting purposes is sent, the recipient has the possibility to choose not to receive it in the future through an unsubscribe link. In addition, it is possible, at any time, to send an e-mail to the following address: [email protected] in order to ask for the discontinuation of such commercial communications.

The use of data and information as described above is authorized by the applicable regulations on the protection of personal data. In most cases, this processing of personal data for commercial prospecting purposes is based on the legitimate interest of Earth Avocats. In addition, where the data subject has given his or her consent directly to Earth Avocats’ partners (such as, but not limited to, insurance companies, comparison sites, social networking platforms, marketing agencies and affiliate platforms, search engines, online real estate listing sites), Earth Avocats may receive his or her personal data. Earth Avocats may use this information to promote its services as described above.  

3 – Online questionnaire

The following information is collected and processed: IP address, postal code, landline and/or cell phone number, and, if applicable, the elements provided in the online questionnaire. The use of this information is made solely for the purpose of establishing contact with the person who filled in the online questionnaire and proposing an exchange or an appointment with an authorized Earth Avocats representative in order to establish a personalized estimate without obligation, and to ensure follow-up after the contact has been made.

This contact will be made by telephone and/or e-mail. The data collected when the completed online questionnaire is sent is kept for a maximum of three (3) years. The use of this information as described above is authorized by the regulations applicable to the protection of personal data. The processing of this personal data is based on the consent of the person concerned.  

4 – When using the website.

The Earth Avocats website uses cookie technology to improve navigation and user experience on the website. During browsing, these cookies may be stored on the browsers of the device used, regardless of the type of device (computer, tablet, smartphone).

They are used in particular during the identification process for monitoring traffic and the use of the site’s features. At any time, visitors to the website can decide to accept or refuse the use of cookies and change their preferences.

The cookie has a validity period that varies according to the type of cookie and enables visitor recognition during subsequent use of the website. In any case, this duration does not exceed thirteen (13) months. Visitors can decide to accept or refuse cookies while browsing the website, and Earth Avocats displays a banner on its website inviting the visitor to accept cookies.

As long as the visitor has not given their consent to the collection of cookies, no cookies may be deposited on their device, with the exception of cookies that are exempt from the collection of consent insofar as they are strictly necessary for the provision of a service expressly requested by the user.

5 –Within the framework of the services provided

the following information is collected and processed: name, first name, address, telephone number and/or cell phone number, e-mail address.

In addition:

1. for the execution of pre-contractual or contractual arrangements with Earth Avocats, with the purpose of:

• prospecting, production, management and follow-up of clients’ queries and cases,
• the drafting of deeds on behalf of its clients;

2. as well as within the framework of the respect of legal and regulatory obligations when it implements a procedure whose purpose is :

• the fight against corruption and the prevention of money laundering and terrorist financing
• Invoicing,
• accounting,

are collected and processed all elements necessary for these purposes. This information is used to carry out the purposes of the requested services. Such processing is permitted by data protection regulations and, in any case, is based on the legal basis of the contract between the data subjects and Earth Avocats, or on the legal basis of legitimate interest. Unless otherwise provided, the above information is necessary to fulfill our contractual obligations.  

6 – Retention of information

Personal data is retained for the purposes listed in this policy. Unless otherwise specified in the preceding paragraphs, the data is kept for as long as the person concerned has a contractual relationship with Earth Avocats. In the event that the contract between the data subject and Earth Avocats is terminated, such as upon completion of the requested service, and if there is no other reason to continue processing, the information will be retained for such periods as are necessary to comply with applicable contractual, accounting, tax, and other regulations and statutes of limitation, or, if applicable, to process any claim or request relating to the services provided. The customers’ personal data is kept for the duration of the contractual relationship plus three (3) years for the purposes of promotion and canvassing, without prejudice to retention obligations or limitation periods. In order to prevent money laundering and terrorist financing, the data is kept for five (5) years after the relationship with Earth Avocats ends. 

7 – Rights related to personal data These are :

• the right to access personal data,
• the right to correct any errors in the files,
• the right to have one’s personal data erased, to limit its processing or to object to it,
• the right to withdraw consent,
• the right to object to receiving commercial prospecting documents in the future,
• in certain circumstances, the right to ensure that such information is transferred to the data subject or to a third party,
